Subcommittee approves changes to high-school athletics governance, including oversight and eligibility updates

The draft would reshape the executive committee by selecting a superintendent, principal and athletic administrator from each classification, stagger terms, require annual election of the executive committee chair, limit automatic-renewal contract clauses for the commissioner, and require the association to submit an annual budget and economic-interest statements. Staff also proposed transfer-eligibility clarifications, a multiplier system for classification that would consider geography and roster size, and a suggested 10% cap on private-school participants on any public-school team to address perceived recruiting and safety concerns.
Kevin Mason of the South Carolina Public Charter School Association said the association asked for explicit charter-school representation on the governing body, noting the league itself recently amended bylaws to add charter representation and asked the committee to preserve that representation in statute: "We are requesting on the governing body structure that there be a fair representation of the full membership, including charters." Speakers representing the league and athletic-administrator groups described recent internal reforms and urged caution about duplicative oversight. William Bowers, speaking for the league's executive committee, noted the league had amended bylaws in March and suggested three-year terms would provide stability. Tony Bell, president of the South Carolina Athletic Administrators Association, asked the committee to pause the bill or vote against sending it to the floor so schools could implement the changes they recently adopted: "We simply ask today that you folks consider not taking this to the floor." Daryl Nance, Greenville County Schools director of athletics and executive director of the South Carolina Athletic Administrators Association, told the subcommittee that many provisions in the bill are already enacted in league documents and asked for time to implement recent changes. Staff walked the committee through proposed language on oversight, appeals, transfer rules, and eligibility.
After extended debate about oversight options (including whether to subject the association to Legislative Audit Council review or periodic legislative oversight), appeals procedures and the impact of NIL and transfer rules on fairness and student participation, the subcommittee voted to report bill 4163 favorably to the full committee.
