Planning commission approves gasoline service station at 479 Marshall St., with stormwater condition

The Planning Commission voted to approve Special Use Permit 26‑03 to allow a gasoline service station at 479 Marshall Street, contingent on the applicant supplying updated stormwater plans that meet city ordinances.

Cody, an architect with Driven Design, told the commission the proposal adds fueling pumps to an existing convenience market and requires no structural changes to the building other than “one window to be able to see the pumps from the checkout area.” The applicant is also proposing a reworked parking area and on‑site stormwater retention where none currently exists.

In the plan director’s staff report, the director cited Section 3.17c (gasoline service stations) and related Section 410 requirements, and noted the city engineer (Fishbach) found the submitted stormwater plans did not meet city standards. “The city engineer said that it did not meet the city’s standards,” the plan director said; the architect replied that updated plans were being prepared to address Fishbach’s comments and that the detention pond would be resized accordingly.

Staff also clarified that the state, not the city, oversees inspection and regulation of buried fuel tanks; the plan director advised the commission to require compliance with applicable state standards in addition to local ordinance conditions.

Commissioners approved the special‑use permit by voice vote after a motion that included a condition requiring the applicant to submit stormwater plans consistent with city ordinances for administrative review and approval. No public comments were received during the hearing.

The commission’s approval leaves the site plan review and final administrative plan sign‑off to staff, pending the revised stormwater and related engineering documents.
