During the committee review of the consolidated temporary-use regulations, a commissioner raised a specific enforcement concern: Jones Brothers’ quarrying activity on the Carmen property appears to meet the code definition for temporary manufacture of road materials and should have come before the board of zoning appeals under the temporary-use provisions.
Commissioners said that consolidation of previously separate urban and county codes revealed inconsistent and, in some places, missing language. The quarry example was cited as a prompt for the committee to take a closer look at temporary-use entries and enforcement mechanisms. Staff said the activity was not brought before the board of zoning appeals and agreed the committee should address how temporary quarries are permitted and inspected going forward.
No formal enforcement action was taken at the meeting; staff was asked to incorporate quarrying clarity into subsequent drafts of the temporary-use ordinance so that enforcement authority and fee schedules are explicit. The subcommittee will review proposed language in a future meeting.
