Leavenworth County Planning Commission approves final plat for The Reserve at Blake Farms with setback exception

The Leavenworth County Planning Commission voted unanimously to recommend approval of the final plat for The Reserve at Blake Farms (case DEV-26-002) and to grant an exception from Article 50, Section 40.3 H for two existing structures that would encroach on a required 40-foot frontage setback.
Planning staff told commissioners the preliminary plat had been reviewed previously, but a later change straightened a cross-access easement. That change would place two structures proposed on Lot 8 about 15 feet inside the required 40-foot setback, which the staff said makes the structures noncompliant under current regulations. Staff said the developer updated the final plat and that septic systems for the house on Lot 3 and the accessory structure on Lot 8 had been identified or brought into compliance.
During the meeting, a commissioner asked who would hold title to Tract A (the combined access tract). The applicant’s agent, Joe Herring of Herring Surveying, said Tract A will be owned by the homeowners association and, if owners initially retain ownership when they sell a lot, the tract will be transferred to the HOA on sale. ‘‘Everything’s going into the HOA,’’ Herring said.
A commissioner moved to approve an exception from Article 50 Section 40.3 H, finding the three required criteria for an exception had been met; the motion was seconded and passed on a roll-call vote with all present commissioners voting yes. The commission then found the subdivision request complies with zoning and subdivision regulations and recommended approval of the final plat to the Board of County Commissioners. The Planning Commission’s recommendation passed unanimously.
The Board of County Commissioners will consider the item no earlier than April 1, 2026, at 9:00 a.m. at the Leavenworth County Courthouse. The planning staff report and the commission’s findings are recorded in case DEV-26-002.
The staff report and discussion noted the need for a formal exception because of the setback encroachment and documented septic-system updates; no public opposition was recorded during the commission’s review.
