Commissioners approve Inter Mountain Sports development agreement, require deed transfer tracking to 2032

Valley County commissioners approved a development agreement for Inter Mountain Sports on March 23 after hearing from the applicant about business urgency and from staff about road‑related conditions.

Staff described a road department request that a 35‑foot strip from centerline be deeded to the county by 2032 as part of the agreement. The applicant, Brian Patterson, told the board he needs a building in place by June 1 to preserve the coming season for his powersports rental business and described recent lease losses that put the business at risk: “We have to get a building up before the 1st of June minimum. If I don't do that, our season's going to be lost and everything basically will be out of business,” Patterson said.

Patterson also explained that the property is under an owner‑carry mortgage, which limits his ability to deed the right‑of‑way until the loan is paid off; staff and commissioners therefore proposed the 2032 deadline. Commissioners asked which office would track the deed obligation over many years in the event of staff turnover. Planning staff said the department has a tracking system for conditions of approval and that the road department and planning could both monitor the deed transfer as a double check.

The board moved and seconded approval of the Inter Mountain Sports development agreement and passed it by voice vote. Commissioners asked staff to include a clear tracking mechanism in the development agreement or county records to ensure the deed transfer and to report back on monitoring procedures.
