S2 read an application from John Hardy requesting an access easement for additional parcels at 10680 South State Highway 3. S4, representing the property and speaking as the applicant, explained the parcel had been divided among heirs and that the requested easement would cross S4’s land to provide ingress and egress to two rear parcels. S4 said the easement needs to be formalized so the survey can be completed and the parcels accessed.
Board members noted a county ordinance that typically limits access to a single parcel from a single easement; they discussed the potential for subdivision issues if easements are not carefully drafted. S2 and others stressed that any approval must include a written maintenance agreement that “runs with the land” to bind future owners. S4 agreed to record such language and to have Chad (staff surveyor) receive the minutes and associated documentation.
S5 moved to approve the easement request subject to recording a written easement and maintenance agreement; the motion was seconded and carried. S2 asked staff to ensure the agreed maintenance terms are included in the recorded documents and survey submittal.
Why this matters: the easement allows legal access to multiple parcels that currently lack separate road frontage. The board conditioned approval on recording a maintenance agreement to reduce future disputes among multiple parcel owners and to ensure long-term access.
