The decision follows a presentation from the applicant's attorney and the project engineer, who described a revised circulation plan that eliminates driveway conflicts and opens a southeast corner of the ground level to improve driver visibility. The applicant asked the board to allow two design waivers that increase curb/curve widths beyond the ordinance limits; the board's engineer reported the revised plan met the circulation and safety concerns raised at an earlier hearing.
The board's approval includes two explicit conditions to be drafted by the board's professionals: language that will limit structures or landscaping that would obstruct the sight lines along the portion of the property fronting Shrewsbury Avenue, and a direction to record the resolution so it appears on title-search records. Board members debated whether a deed restriction or a condition of approval was appropriate; counsel advised against an outright deed restriction and favored a recorded resolution and conditions enforceable through normal land-use compliance procedures.
Members also required the applicant to shift mechanical equipment that faces neighboring homes. The applicant agreed to move the air-conditioning platform inward; during discussion the team estimated the shift at roughly 8 feet. The project engineer said the scheme provides five on-site parking spaces; together with street parking the project meets the 10-space requirement the board enforces for this zoning.
Board members asked for targeted, enforceable language that limits both structures and plantings that would impair visibility; the applicant and counsel said they would work with town professionals to draft conditions that run with the recorded resolution. With those conditions and the two design waivers, the board recorded a unanimous approval.
The board's action closes the matter for tonight; the resolution language and any recorded documents will be prepared by staff and added to the public record when filed.
