Fernley adopts ordinance to permit alcohol delivery from licensed food establishments

The Fernley City Council adopted an ordinance implementing AB 375 to permit off‑premise delivery of sealed alcoholic beverages by food establishments already licensed for on‑premise sales.
City staff explained the ordinance (Bill 369) at the public hearing and recommended adoption. The ordinance allows covered food establishments to prepare sealed cocktails for delivery and requires delivery drivers to complete mandatory training and use tamper‑evident packaging to prevent open‑container violations and ensure chain‑of‑custody. A $0.50 per‑drink surcharge will fund an expanded ignition‑interlock and DUI prevention program, staff said.
Council clarified the scope of covered businesses—grocery stores were not automatically included; the ordinance applies to covered food establishments currently licensed for on‑premise sales—and asked how compliance with training and business licensing for app‑based delivery drivers will be enforced. Staff said establishments are responsible for ensuring drivers meet training requirements and that the city will seek cooperation from the Nevada Restaurant Association to communicate obligations to third‑party delivery drivers.
Councilman Laau moved to adopt Bill 369 as presented; the motion carried 5–0.
