The Falmouth Conservation Commission declined on March 25 to issue a certificate of compliance for work at 29 Noset A (Mass DP25‑4627) because staff identified an outstanding tree replacement requirement.
Alyssa (Conservation staff) told the commission the replacement tree removed during an earlier septic upgrade had not been replaced on the property in accordance with the permit or staff agreement. The owner, Edmund Dapion, said he was prepared to work with staff to identify an acceptable native understory tree and a location on the property; staff suggested planting in the backyard where there is room and insisted the tree be a native species.
After discussion, commissioners voted not to grant the certificate of compliance pending proof that the required replacement tree has been planted. Staff will coordinate with the owner to agree on species and placement and will issue the certificate once the planting is completed and inspected.
Next steps: Applicant and staff will settle on a native understory species and planting location; once planted and verified, staff can administratively issue the certificate of compliance.
