CalPERS legislative staff on April 20 briefed the Board of Administration on state and federal bills and two recent regulatory comment letters to CMS and the SEC.
Danny Brown, who delivered the state and federal update, said the board‑sponsored SB939 passed a committee on consent and that two bills recently gutted and amended raise staff concerns. "SB1089 by Senator Richardson ... appears to require every CalPERS health plan to offer optional coverage of GLP‑1s for weight loss at the most‑favored‑nation price," Brown said, adding that the author’s stated intent may differ but that the bill’s current language would force CalPERS to apply the benefit to all plans if enacted, risking adverse selection and program instability.
Brown also discussed SB1319, a bill sponsored by labor groups that would expand public‑records disclosure for private investments. "If this bill rolls back longstanding protections for private‑investment records, it could put CalPERS at a competitive disadvantage with other institutional investors and limit our access to top general partners," Brown said, warning this could hurt returns, increase contributions and impede climate‑investment goals aimed at reaching a $100 billion climate action target by 2030.
On federal matters, Brown summarized two comment letters: one to the Centers for Medicare & Medicaid Services on proposed rules intended to uncover "suspicious health care," urging clearer definitions and use of data transparency; and another to the Securities and Exchange Commission urging preservation of investor‑protection disclosures and cautioning against diluting critical executive compensation or human capital disclosures.
Board members asked staff for more detailed cost modeling and asked the board to schedule a May session to review SB1319 with private‑markets consultants (Wilshire and others) to assess fiscal and portfolio implications.
