Brookfield adopts ordinance regulating location of smoke and vapor shops

The Common Council of Brookfield City adopted an ordinance on March 3 that regulates where smoke and vapor shops may locate in the B-1 Local Business District and adds related definitions to the municipal code.
Mayor Steven V. Ponto opened a public hearing at 8:00 p.m. on a request to amend Chapter 17.52 to permit smoke and vapor shops as a permitted use with specified location restrictions for new occupancy permits and to amend Section 17.04.020 to include definitions for “Smoke and Vapor Shops,” “Tobacco Products,” and “Tobacco Vending Machines.” City Attorney Jenna Merten described the matter as a legislative referral, said mapped locations and grandfathering for existing businesses were part of the proposal, and noted locations were determined in relation to schools and parks.
A motion by Alderman Gary Mahkorn, seconded by Alderman Chuck Bloom III, closed the public hearing at 8:03 p.m. The council later adopted the ordinance regulating the location of smoke and vapor shops on a unanimous roll call vote (14-0). The ordinance is recorded as Ordinance No. 2925-26.
