Council tables Silver Creek rezoning after questions about removing 2006 proffers, access and design standards

The applicant requested removal of five proffers submitted in 2006 and offered three new commitments, including phased construction of a road connection to Booker Dell Road, dedication of right-of-way for the Ludowici–Rosser connector, and general conformance with a submitted preliminary plat showing about 100 single‑family lots.
Planning staff noted some original proffers had become obsolete (stormwater rules, pump station) while others—such as a contribution toward a bridge replacement and architectural guidelines—remain of concern to some residents. Staff supported preserving the Booker Dell connection right-of-way but acknowledged removing a bridge‑contribution proffer given plans for the larger connector alignment.
Councilors and staff expressed unease that, as proposed, much of the subdivision could be built before full public access to the connector is provided and that existing purchasers may have expected original design guidelines. A motion by Councilor Short to table the item was seconded and approved; staff will continue to work with the applicant to seek revisions or proffers that address architectural and phasing concerns.
What happens next: Staff will reach out to the applicant to seek further commitments, and the item will be brought back to council when both sides agree or staff determines an appropriate date.
