Marshall Council approves $679,229 contract for South Fifth Street reconstruction

Marshall City Council on a motion approved a contract award for the South Fifth Street reconstruction project and adopted a parallel financing resolution.

City Engineer Jason Anderson told the council that four bids were opened on April 10 and the low, responsible bid was submitted by Action Company LLC (Marshall) for $679,228.98, which he said fell within the city engineer's estimate of $635,000 to $745,000. He noted the second-low bid was within about $500 of the low bid on a roughly $679,000 project and described the bidding environment as very competitive. "The low bid was provided by Action Company LLC of Marshall in the amount of $679,228.98," Anderson said.

Before awarding the contract, council members passed a resolution declaring the council's official intent to reimburse project expenditures from the proceeds of tax-exempt bonds. Councilor Craig moved the reimbursement-resolution, which was seconded and passed; council then moved to accept the low bid and award the contract to Action Company LLC. Voting was recorded as "the motion does pass" in the meeting record; the transcript does not list individual yes/no votes.

Anderson told members staff plans to special-assess the project in accordance with city policy and said staff had met with Action Company after the bid opening to discuss expectations. He said staff had not worked with Action previously on a reconstruction project but expressed confidence in the contractor's ability to deliver the work.

The council approved the recommended award and financing-resolution at the meeting. The contract value and the financing resolution were the most recent formal actions recorded; the city did not provide an implementation schedule or financing closing date in the meeting discussion.

The council also approved other related public-works items on the agenda that evening, including a separate sanitary-sewer repair contract (see separate item).
