The Flagler County Planning and Development Board unanimously approved a variance allowing a pool and pool deck to sit five feet from the rear property line at 21 North Riverwalk Drive on April 14, 2026.
Planner Simone Kenny told the board the subject parcel (lot 74, Palm Coast Plantation Unit 1A) is roughly 9,000 square feet and unusually shallow compared with neighboring lots, creating an irregularly angled rear property line. Because the minimum rear setback in the subdivision is 10 feet, the owner requested a 5-foot rear setback variance to accommodate a proposed pool, pool deck, cabana and fire pit. Kenny said the applicants had obtained HOA and ARC approval and that staff found no public comments in the record for this item.
Board members asked no substantive follow-up questions. Owner George Hul appeared and offered to answer questions but declined to repeat staff’s presentation. With no public speakers, a board member moved to approve the request, the motion was seconded, and the roll call vote was unanimous in favor. The planner had read the variance criteria into the record, describing the lot’s smaller area and depth as the basis for hardship and noting the pool is a permitted use in the PUD.
The approval authorizes Project 2026200046: a five-foot rear (west) yard setback variance from the subdivision’s 10-foot rear setback requirement to allow the pool and pool deck at 21 North Riverwalk Drive. Staff recorded the decision and closed the item without further conditions.
The board moved to the next quasi‑judicial case after approving the variance.
