Aaron Ryder, director of the Utah HOA Ombudsman Office, outlined several administrative changes that homeowners, boards and managers need to implement before many provisions take effect May 6, 2026.
On registration, Ryder said the legislature removed the requirement to include physical mailing addresses on the state registry to address privacy concerns. "The board chair or the president is going to still be required to put in their name, phone number, and an email address if applicable," he said; other board members must provide their names and may provide phone/email voluntarily. Managers must provide contact information and associations will indicate on the registry whether they charge reinvestment or administrative setup fees (a yes/no box, not the amount).
On records access, Ryder said the statutory response timeline was clarified: associations or their managers have 10 business days to respond to a records request; the $25-per-business-day penalty begins on the 11th business day. He stressed that associations cannot charge owners for electronic delivery of documents (online portals), though reasonable fees for physical copies remain allowable under statute.
Ryder also reminded real estate professionals that the seller—not the buyer—has the statutory right to request recorded CCNRs and similar documents from an association; sellers must provide those documents to buyers under typical contract practice. He urged buyers and agents to allow time for the 10-business-day response window when scheduling closings.
The office will post webinar slides, a home-buyer checklist and sample minutes and templates on ha.utah.gov and on the state's My Utah portal; Ryder encouraged attendees to consult attorneys for specific legal questions and to reach out to the Ombudsman Office for statutory clarifications.
