The Plan Commission on April 15 recommended approval of Resolution 07-2026 to modify a locally administered access restriction on State Trunk Highway 195 so the driveway location for a funeral-home property matches the recorded title and the buyer can complete a sale.
Sam explained the restriction dated to an earlier era when the route was a county trunk highway and that the Department of Transportation indicated the restriction is administered locally. An attorney for the property owner, Nick Faland, told the commission an ALTA survey by the buyer identified the restriction, and the request is to remove the restriction for the existing driveway while keeping other access restrictions in place along the frontage.
Commissioners asked staff to ensure DOT communications are in writing. A motion to recommend approval for the village board carried unanimously; staff said the village board will likely place the item on its consent agenda to clean up the title.
