Conservation commission denies partial certificate as stormwater basins fail at 30 Sergeants Way

The Brockton Conservation Commission on April 15 denied a request for a partial certificate of compliance for 30 Sergeants Way after the commission's agent reported significant erosion and failing stormwater basins on the property.

Azu, the applicant’s representative, told the commission the site has been through three economic cycles and that most work is complete but that landscaping and permanent conservation markers remain unfinished. He asked the commission to issue a partial certificate so a tenant could occupy the building while final plantings and markers are installed. "We are asking that the commission find that that is very minor in nature," Azu said.

Kyle, the commission agent, recommended denying the certificate until the washed-out sediment forebay and clogged infiltration basin are repaired and erosion controls are installed. "I'm not recommending that the commission issue any sort of certificate of compliance tonight," Kyle said after describing on-site observations and photographs showing the washed-out swale and sediment accumulation.

Commissioners debated whether to continue the hearing to allow repairs or to deny outright. Concerned about repeated continuances and the time needed for stabilization and plant germination, the commission voted by roll call to approve a motion to deny the request. The motion passed on a recorded roll-call (commissioners voting in the affirmative: Clay; Lily Green; Matt; Leon Edwards; Boris; Justin Talbat).

The applicant said they will begin repairs and will reapply once the site is stabilized and permanent markers are installed.

What's next: The applicant may submit a new request for a certificate after repairs and stabilization are complete; the commission indicated it may accept a continuation to June if the applicant shows substantial progress.
