The Montgomery County Planning Commission unanimously approved Rezoning 26-2 on April 15, 2026, changing 0.6359 acres of a 15.79-acre parcel at 1220 Panorama Drive from manufacturing (M1) to agricultural (A1).
Staff presenter Miss Wright told commissioners the portion under review had been rezoned in 1998 with proffered conditions and carried a special use permit for a contractor’s storage yard that has not been used for more than two years. Wright said the storage-yard activity ceased, the special use permit is now void and the parcel’s current private use is more consistent with agricultural zoning. The parcel is identified as Tax Map 029-A8, Parcel ID 025376.
Wright described site features including a non-habitable single-wide mobile structure, a garage previously used for contractor storage, and a 15-foot private access easement that provides access to an adjacent home and a substation. She said the site is on private well and septic and that no immediate improvements are proposed; any future platting would evaluate infrastructure needs.
The rezoning request was filed by Carolyn Flinchum and was presented on behalf of the owner by her nephew, Mr. Rackcliffe, who is expected to occupy a new lot if the parcel is subdivided. Commissioners asked whether a transfer to the nephew would change the planning analysis; Wright replied it would not, since the proffered business use no longer exists and the proposed downzoning brings the property into alignment with its current use.
After Wright closed her presentation, the commission opened a public hearing; no members of the public spoke. A commissioner moved to approve the staff recommendation and the motion was seconded. Commissioners recorded an affirmative voice vote; Chair Foster announced the motion carried unanimously.
The action removes the split-zone condition on the parcel and returns the affected area to agricultural use, which staff said creates fewer potential impacts and better reflects existing land use on the property. No voluntary proffers were attached to the staff recommendation. The commission did not attach conditions as part of the approval.
Next steps: the approved rezoning will be recorded in county records per standard procedures and any future subdivision or replacement of the mobile structure will proceed through the county’s platting and permitting process.
