Business administrator says contract with Unique Security was rescinded after bond and wage-certification failures

The Newark business administrator told the Municipal Council that the city rescinded a contract with Unique Security and Consulting after finding two compliance failures. "They failed to provide the appropriate bond, which is a fatal flaw," Eric Pennington said. He added the vendor also "failed to represent and certify that they would be paying the appropriate wage as set forth in the requirements under the RFP."
Pennington said the city has extended an emergency contract with the current provider for six months and will issue a new request for proposals for security services. He framed the rescission as required under procurement rules: without the bond the bid was not permissible and could not be modified after execution. "So they had to be terminated," he said.
Council members asked no further questions after Pennington's explanation and moved on to other agenda items. The council did not vote in public session to ratify the rescission during the segment captured in the transcript; staff described the administrative steps taken and next procurement actions.
