The Committee on Real Estate voted to authorize the mayor to execute a termination and release of a reserved 60-foot right-of-way affecting parcels near Miz and Mast Road and Ripley Point Drive.
City staff presented a table showing the two parcels in question and explained that a Planning Commission condition from 2004 had placed a 60-foot right-of-way across the parcel. Miss Copelan said a single owner now holds both parcels and intends to sell both to a developer proposing high-end townhomes; the owner’s title insurer requested that the council vote to terminate the reserved right-of-way to clear title for the transaction.
Miss Copelan noted Ripley Point Drive is private and that the reservation was a 2004 Planning Commission condition. A committee member asked the age of the reservation; staff confirmed the 2004 origin. The committee voted by voice vote to terminate and release the reservation; the motion passed with no recorded roll-call tally.
The action removes the recorded reservation that had run across the parcels and clears a potential title impediment cited by the owner’s insurer. The vote followed staff presentation and a brief question about the reservation’s origin; no amendments or conditions were recorded at the meeting.
