ZBA roundup: appeal filed on Broken Bow safe‑harbor decision; Ginwall addition approved; Ocean View continued

The Town of Falmouth Zoning Board of Appeals handled multiple routine and contested items in one session.

Chair Suzanne Murphy opened the meeting, reviewed hearing procedures and introduced members and staff. Early in the meeting the board voted to appeal an Executive Office of Housing decision that found the town did not qualify for a safe‑harbor determination in the Zero Broken Bow matter; the board stayed its local hearing pending the outcome of that state appeal.

The board then reviewed three property hearings on the agenda. On the modest residential request at 9 Ginwall Street, the applicant sought a special permit to remove a nonconforming garage and construct a small addition. After a staff presentation, applicant testimony, and board questions about setbacks, stormwater and a pre‑existing shed, the board closed the hearing and approved the special permit with standard engineering and erosion‑control conditions.

At 43 Ocean View Avenue the homeowner sought to add a first‑floor bedroom and return the house to a four‑bedroom configuration she says historically existed. Referrals from the wastewater superintendent and board of health indicate the sewer district currently permits three bedrooms; the board continued the matter to April 30 to give the applicant time to gather assessor records, conservation plan detail and a written reply from wastewater/health officials.

The meeting also included minutes approval and other routine business.
