The Ways & Means committee approved a technical amendment to a yield bill that clarifies an appropriation to reimburse the city of Berry for TIFF overpayments totaling $150,576.
John Gray of the Office of Legislative Counsel explained the change replaces language that previously said a "transfer" with wording that "appropriates" the same sum from the ad fund to the Department of Taxes so the department can make the payment to Berry. Gray described the change as technical and not altering the amount or coverage period; he identified the sum as $150,576 appropriated in FY27 for the reimbursement.
Members said the overpayment resulted from a software error affecting TIFF calculations across multiple fiscal years. Committee discussion noted that an earlier repayment covered years FY16–FY20 and that this action addresses the remaining years through FY24; members said the underlying software issue has been fixed.
Representative Maslin moved, and Representative Kimell seconded, that the Cornheiser amendment to H949 be found favorable. The clerk called the roll and the amendment was recorded as found favorable (transcript prints the result as "found the amendment favorable 1001").
The committee said the change is procedural and intended to ensure the appropriation authority is explicit so the Department of Taxes can make the payment to the city of Berry.
