The Rye Brook Planning Board approved an amended landscaping plan for the Enclave (the HOA bordering the Blind Brook Club) after the club’s counsel raised questions about how tree removals and replacements would be managed over time.
Attorney Daniel Con told the board that the Blind Brook Club was concerned that the plan did not clearly indicate which existing trees would be removed and how replacements would be staged. Village staff and the applicant’s representatives said the amendment is intended as a long-term template to guide future plantings as trees decline, not an immediate mass removal. Staff explained tree removals will still be subject to the village's standard tree-permit process and the amendment will function as a written standard the HOA must follow when replanting.
To address the club’s concerns, the board directed staff to add clarifying notes to the amended plan and to include language in the resolution that the plan will be implemented over time and is subject to village permitting for any tree removal. The board also required a substitution: the proposed Norway spruce will be replaced with a native evergreen species to the satisfaction of the village planner and superintendent of public works.
After closing public comment, the board adopted the amended resolution by roll call. The resolution requires submission of a construction management plan to the building inspector and DPW engineer, reaffirms that tree removals will occur only with village permits, and directs the applicant to update plan notes to clarify staged implementation.
