Delafield council disallows Fabick GB LLC fire-fee claim, convenes closed session on impact-fee appeal

The City of Delafield Common Council reconvened in open session April 20 and voted to disallow a Jan. 7, 2026 claim by Fabick GB LLC alleging damages from payment of fire protection fees for 2023–2025.

Mayor Iker announced the matter and council moved to disallow the claim; the motion carried on a voice vote. The claim and the council’s action were presented immediately after a closed-session consultation with legal counsel that had been called to address two items: a Metropolitan Builders Association complaint seeking statutory review of the council’s decision on impact fees, and the Fabick GB LLC claim under the statute cited in the agenda paperwork (transcript reference: “Wisconsin statute 89380”). The council recessed to closed session to consult with counsel pursuant to the Wisconsin statute listed on the agenda, then returned to open session to act on the claim.

City staff did not provide additional factual findings in open session about Fabick GB LLC’s underlying allegations; the action taken in public was the council’s formal disallowance of the claim. The council’s closed-session consultation on the Metropolitan Builders Association appeal was announced on the record but, consistent with the statutory basis cited, the discussion remained in closed session and no deliberations from that closed session were disclosed.
