During public comment on April 21, resident Ryan Hinton urged the Fairbanks North Star Borough School Board to continue opposing Borough Code 704125, which he said enabled an $11.4 million clawback from district education funds and effectively penalized the district for holding reserves.
Hinton told the board the Borough’s unrestricted fund balances total about $165 million — roughly 74% of the Borough’s annual expenditures, by his figures — while district education funding and state revenues have declined in recent years. He said the code imposes a 10% reserve target on the district and then uses a clawback mechanism that he described as unfair and harmful to school programming.
"The district is not guilty of misusing tax dollars because y'all failed to land somewhere between insolvency and the 10% reserve limit the Borough has set," Hinton said. He urged the board to demand rescission of the code and to push the Borough to apply equivalent fiscal standards to its own reserves.
Board members acknowledged receipt of the testimony. Staff later noted that district budget conversations with the Borough Finance committee are ongoing, with the assembly holding a public hearing on their budget May 7 and a final vote May 14.
The comment was part of a broader public-comment period that also included concerns about classroom behavior, libraries and other community topics. No formal board action on Borough Code 704125 was taken at the April 21 meeting.
