The Planning Commission approved a request from Marabella subdivision to build only the half of a required street along its southern boundary, after staff said the waiver meets local standards and that drainage and future right‑of‑way dedication will be handled during plan review.
Brio Whitmire of Development Services told commissioners the property’s southern edge borders farm fields and that the waiver request is judged under UDCA section 8.2.1(f). Whitmire said staff found the deviation would not be “detrimental to public health or safety” and that the proposal still provides required two‑way traffic lane widths and connectivity.
Commissioners pressed staff on stormwater and long‑term dedication. One commissioner asked whether the developer would be required to extend drainage infrastructure now or leave interim measures such as a bar ditch for a future developer to upgrade. Whitmire replied the detailed design has not been submitted and that “staff will make sure in the review that stormwater is addressed on this design so it’s not pushing any water onto that other landowner,” and that the right‑of‑way dedication on the adjacent parcel will be required when that parcel plats.
Staff noted that the parcel is zoned C3 under a recent UTP amendment and that half‑street configurations are common where neighboring owners have not dedicated the full right‑of‑way. Commissioners were told the alternative would be to require the applicant to dedicate and construct the entire 75‑foot right‑of‑way now, which would place a larger immediate burden on the current developer.
After no public comment, a commissioner moved to pass the waiver as presented by staff; the motion was seconded and passed on a voice vote with no opposition recorded. Staff said conditions and technical requirements — including stormwater crossings and right‑of‑way tie‑ins — will be enforced at plan review and through right‑of‑way permitting.
