The South Weber City Planning Commission on Feb. 13 voted to recommend that the City Council approve a minor map correction rezone and the preliminary subdivision plat for the South Weber Gateway project, adding a condition that future documents explicitly label the commercial units as "Gateway commercial condominiums."
The action covers a roughly 0.02-acre adjustment to the commercial area in the Gateway development agreement and a preliminary plat showing 13 commercial "pads" along South Weber Drive. During public comment, Paul Sturm said staff packet pages appeared to label those pads as "Condominiums" and asked, "please explain how one can propose Condominiums residences in a commercial Zone," expressing concern the labeling could be read as residential development.
Staff told the commission the change is a technical map correction that aligns the zoning map with an amended concept plan in the development agreement. Staff also explained that "condominium" is a form of ownership defined by state code, not necessarily a residential use; the hearing record repeatedly described the proposal as commercial in nature.
Justin Neelson of Stillwater Construction Group, the applicant, said the project "is fully vetted and...we're ready to move on it," and answered commissioners' technical questions about retaining walls, fencing, landscaping buffers and maintenance. Neelson said geotechnical reviews have been done and that portions of the hillside will be retained while other sections receive vegetative treatment; he estimated wall heights at roughly six to eight feet at the tallest point. He also said commercial-conducted common-area maintenance would fall to the project's ownership organization once tenants are established.
Commissioners discussed site details including potential berms, masonry or vinyl fencing (with no chain-link), relocation or buffering of sidewalks, coordination with UD for turn lanes and signage, and a two-phase construction approach (east then west). A commissioner moved to recommend approval of the preliminary plat and to forward the rezone recommendation to City Council, adding an explicit condition that the documents use the label "Gateway commercial condominiums" to avoid implying residential use. The motion passed on a roll-call vote; individual vote tallies were recorded as affirmative in the meeting record but not fully specified in the transcript.
