Poweshiek County supervisors adopt solar and nuisance ordinances, waive third readings

The Poweshiek County Board of Supervisors on May 7 unanimously adopted two ordinances — a new set of regulations for utility-scale solar and battery storage and an ordinance adopting Iowa Code Chapters 657 and 657A to govern nuisances — and directed the county auditor to publish both in the county’s official newspapers.
The board, meeting at 8:30 a.m., approved the second reading of Ordinance No. 33, "An Ordinance Adopting Regulations for Utility-Scale Solar Energy Systems (US-SES), Battery Energy Storage Systems (BESS), and Commercial Energy Battery Storage Systems (C-BESS)," and by resolution (No. 2026-46) waived the third reading and adopted the ordinance by a 3-0 vote. Supervisors Jacki Bolen moved the measure and Jeff Tindle seconded. Chair Jason Roudabush was recorded in favor. Auditor Melissa Eilander confirmed the ordinance will be published as directed by the board.
The board then approved Resolution No. 2026-47 to adopt Ordinance No. 34, "An Ordinance for the Purpose of Adopting Iowa Code Chapter 657 and 657A to Prohibit Nuisances Within Poweshiek County and Providing for Enforcement and Penalties," also by a 3-0 vote (motion by Jeff Tindle, second by Jacki Bolen). The board recorded that no members of the public were present to speak for or against either ordinance at the public hearing.
Both ordinances were brought to the May 7 hearing with no public comments filed in advance, according to remarks from the board, Sanitarian/Zoning official J.D. Griffith and Auditor Melissa Eilander. The board closed the public hearing at 9:02 a.m. after hearing no comments and then voted to adopt each ordinance and to have the auditor publish them in the county newspapers as required.
In other routine business the board approved payroll for May 8, 2026, in the amount of $338,138.85 and approved a claim for Moody’s Investors Service for bond services totaling $21,000.00. The board also approved Resolution No. 2026-48 updating Poweshiek County Treasurer depositories and raising the maximum deposit amounts with Fidelity and First State Bank to $10,000,000 (as stated in the resolution), which is on file in the auditor’s office.
The supervisors granted a liquor license to Triple K Sips LLC, d/b/a Lucky Wife Wine Slushies, for an event scheduled May 24, 2026, at 268 Center Point Drive in Montezuma, and approved several routine agenda items at the start of the meeting, including the agenda and prior meeting minutes. The board discussed a draft lease agreement with the Poweshiek County Sportsman Association for the county shooting range in Malcom Township but took no formal action on that lease during the session.
Supervisor Jacki Bolen said she will attend a Poweshiek County Economic Collaborative workforce subcommittee meeting the following day. The board adjourned at 10:58 a.m.
