DCR seeks amendment for Walden Pond bathhouse work; NRC and applicants discuss bank boundaries and schedule

Matt Burn, a professional wetland scientist and senior ecologist with BSC Group, and Dom Rinaldi, the project civil engineer, described the proposed red‑lined work area on presentation imagery and emphasized the difficulty of fixing the boundary between bank and land under water because pond levels vary seasonally and interannually. Burn said the bottom‑of‑bank definition is mean annual low water, but that establishing a mean requires many years of measurements; the area currently exposed in spring made the proposed sand placement appear outside land under water. Commissioners and applicants discussed recent survey lines (a higher water level in a 2018/2019 survey) and the need for a clear revised project description.
Applicants said phase one (the bathhouse) aims to open for the Memorial Day weekend (around May 24) and that phase two (the accessible boardwalk) would likely go out to bid in late spring with construction expected in the fall. Staff told applicants an amended order was not ready for issuance that night and asked them to provide a revised project description; staff will check the permit expiration date (one extension was granted in 2025) and advise whether an additional extension is needed.
Why it matters: Work at Walden Pond involves public recreation and sensitive shoreland resource areas. Accurate delineation of bank, mean low water and land under water influences which activities are permitted and what conditions are required to protect wetland interests.
