Council resists quick buyout offer for denuded conservation easement, asks staff for policy and restoration options

A developer representative told the council that Sheltering Palms would pay $250,000 to remove a two‑acre conservation easement on a larger parcel that council members said has been heavily denuded. The property’s easement, plotted on the parcel’s eastern edge, was described to council as effectively cleared and no longer providing the conservation value intended when the easement was recorded.

Several council members said the town must not adopt an ad‑hoc process for legacy conservation easements. Council directed staff to return with a uniform policy and to prioritize restoration obligations for easement owners where feasible rather than approving an outright cash buyout. Council members also suggested allowing mitigation funds to be used for improved, consolidated conservation sites that would provide more public or ecological benefit than small, isolated parcels.

Town attorney Jeff Kurtz and community standards staff said the town can inspect easement conditions and, where necessary, require or negotiate restoration. The town will prepare a draft policy that explains when mitigation buyouts are allowed, how mitigation funds will be used, and the restoration or relocation options available to landowners. Sheltering Palms was asked to submit a restoration plan if it wishes to pursue release or to negotiate mitigation consistent with the forthcoming policy.

Next steps: staff will draft an easement policy; council will review restoration vs. buyout options; Sheltering Palms will be invited to propose a restoration plan under the town’s policy framework.
