Council approves amendment to developer agreement to build Brickyard Creek crossing as part of Trail Road arterial

The council authorized the mayor to sign an amendment to a development agreement with Bucko Surveyor's Trust LLC that allows the planned Brickyard Creek crossing on the North Trail Road arterial to be constructed as a larger crossing (bridge) rather than the previously contemplated smaller culvert.
Public works staff explained that project design revealed hydraulic needs exceeding the originally anticipated culvert size and that state rules treat longer spans as bridges (over 20 ft), which has inspection and design implications. Staff said the public portion of the arterial project is budgeted and that REET (real estate excise tax) funds will be used to cover the city’s incremental costs; finance modeling through 2029 indicates the city can fund the change while maintaining a multimillion-dollar cushion for other planned projects.
Why it matters: The crossing is a piece of the Trail Road / Jones‑John Liner corridor and its capacity will affect traffic and flood conveyance. Changing to a bridge affects design, permitting, inspection and cost. Council authorized the agreement amendment by motion.
