Law and Ordinance Committee forwards parklet permit proposal and seeks repeal of an outdated smoking rule

The Law and Ordinance Committee voted on multiple code changes during a short meeting, agreeing to forward a proposed ordinance that would add section 145.09 to regulate parklets in city rights-of-way and to ask the law director to consider repealing an apparently outdated smoking-policy provision.
A committee member introduced the parklet proposal as a way to support downtown activity and community gathering, and the committee moved to submit the proposed ordinance to all of council for formal consideration. Committee members said the measure would formalize a parklet permit process and could help businesses by enabling regulated outdoor seating and activity in the spring and summer.
During the same discussion, a member noted that chapter 145 includes section 145.06, a provision directing departments to develop smoking policies that was enacted in 1979 and appears no longer applicable. The committee moved to request that the law director review that provision and prepare the appropriate repeal or corrective language for council consideration.
The committee did not take final legislative action beyond the referrals; members asked the law director (Stephanie) to advise on whether formal repeal would require an ordinance, resolution or a simpler council action and to draft revised language. The items are expected to appear before full council after staff review.
