Morgan County adopts ordinance setting right-of-way permit fees; fees to go to MVH fund

Morgan County commissioners voted on April 20 to adopt ordinance 2026-4, updating the county’s fee schedule for work performed in the public right-of-way. The board voted to waive the second reading and adopt the ordinance by voice vote.
County staff said the fees are modeled on nearby Hendricks County’s schedule after reviewing fee structures from several neighboring jurisdictions. ‘‘We went with what Hendricks County charges…because they were close by and made sense for our parameters,’’ a county official said.
Staff explained that fee revenue will be collected into the Motor Vehicle Highway (MVH) fund. "Any of the fees we collect goes to MVH funds so we can use it to put back in and take care of the roads and infrastructure," a commissioner said; staff noted that using those funds for projects requires a separate appropriation.
The ordinance adds a fee schedule to the existing permit application process on the county website and may require bonds for larger projects, as allowed under the statute being amended. Commissioners agreed to waive the second reading so the fee schedule could take effect without delay; an effective date was not specified during the discussion.
The board recorded the motion to accept ordinance number 2026-4 and to waive the second reading. Staff said the county will add the fees to the permit tab on the website and follow existing MVH appropriation processes for any spending.
