Neptune Beach OKs first-reading change to treat easement vacations like right-of-way vacations

At first reading April 6 the Neptune Beach City Council approved ordinance 2026-04 to clarify that easement vacations be treated comparably to right-of-way or land vacations for valuation and appraisal purposes.
Planner Miss Whitmore told the council the existing code requires an appraisal for right-of-way vacations but does not explicitly require the same appraisal language for easement vacations. The ordinance would add that appraisal/valuation requirement so the public valuation component is consistent regardless of whether an easement or full property vacation is involved.
Councilors asked whether routine right-of-way permits for minor landscaping would be affected; Miss Whitmore said the intent is not to change the permitting regime for minor improvements, which occur frequently and would not be subject to the appraisal requirement. Councilor Messenger asked whether the draft language could be tweaked to avoid future misinterpretation; the council adopted the ordinance on first reading with direction for staff to refine the drafting language.
The motion to approve included the direction that staff modify the language as discussed; the roll call recorded unanimous support.
Staff will return with the refined language on a subsequent agenda.
