Ethics review finds no merit in complaint alleging mayor organized religious rally

Mr. Jones presented the results of a review of an ethics complaint filed by Trenton Strode alleging Mayor Randy Porter organized a religious "King of Kings" rally on courthouse grounds. Jones told the commission the complaint was unsigned and therefore procedurally defective, and concluded the county ethics committee lacks authority over the matters raised because the complaint did not allege violations covered by the county's code of ethics or Tennessee Code Annotated 8‑17‑101 et seq.
During the factual review Jones said Mayor Porter had spoken with a representative of the Putnam County Young Republican Group about scheduling and logistics but was not the organizer, promoter or planner of the event. ‘‘Based on my investigation, I believe Mr. Strode misinterpreted the statement made by Randy Porter at the mayoral debate,’’ Jones said, and he recommended the Ethics Committee and the Commission take no action.
Jones also summarized the legal framework: county ethics rules (adopted in 2007 using the CTAS model) address conflicts of interest and gifts; federal and Sixth Circuit precedent permit religious expression in a neutral public forum, and Tennessee courts have not adopted a rule that courthouse grounds are per se closed to religious expression so long as access is neutral. The presenter concluded allowing a religious rally on neutral terms does not constitute unconstitutional endorsement and recommended no enforcement action by the county ethics body.
Commissioners did not take separate formal action on the recommendation during this session; Mr. Jones’s report and recommendation were entered into the record and the presenter closed by recommending no further action.
