The Summer Zoning Board on Aug. 20 dismissed a withdrawn application for 106 Veterans Moral Drive without prejudice and agreed to carry the Princeton Cana LLC matter to Wednesday, Sept. 3 at 7 p.m.
An applicant representative told the board they would like to withdraw the application for the two-family lot at 106 Veterans Moral Drive. Counsel and staff advised that dismissal without prejudice was appropriate to clear the docket; the board moved to dismiss the matter without prejudice and recorded unanimous affirmative votes from members present. Counsel noted that dismissal stops the clock and prevents a default approval; staff flagged potential escrow issues that the applicant must resolve separately.
Earlier in the meeting members also discussed a separate application for D-relief linked to the Princeton Cana LLC matter. Because D-relief requires five affirmative votes and several regular members were absent, a board member recommended carrying the application to a meeting when the full board could be present. After a brief recess and a confirmation that the application's notice was sufficient, the board accepted jurisdiction and formally adjourned the Princeton Cana LLC application to Sept. 3 at 7:00 p.m. at Borough Hall; the board said there would be no further notice.
Both procedural decisions were recorded on the public record. The dismissal of 106 Veterans Moral Drive was entered without prejudice, allowing the applicant to refile in the future; the Princeton Cana LLC hearing will be scheduled for the first September meeting at the stated time and place.
