ZBA grants rear-setback waiver after neighbor support for Ginsbergs’ aging-in-place home

The Oak Park Zoning Board of Appeals approved a rear-setback waiver to allow homeowners Barry and Martha Ginsberg to complete a new house with design elements for aging in place, including a first-floor master and an attached garage.
Architect John Novitsky told the board that after placing the concrete footings the project team discovered the local street is built about 2 feet deeper into the lots than county records showed, which left the planned building slightly forward of the expected location. Novitsky said the design still met overall area limits and that he had sought neighborhood input; he reported "unanimous support from their neighborhood."
Neighbor Sanford Greenberg of 14810 Talbot spoke in favor of the proposal, saying renovations have improved the street and that he and his wife "are in 100% support of this variance." The motion approved a waiver of 2 ft 4 in to allow a rear yard setback of 27 ft 8 in where the ordinance requires 30 ft (Article 2, Division 2, Section 214). The board recorded members voting yes by roll call and the motion carried.
The approval allows the homeowners to proceed with their build subject to standard permitting and any future zoning requirements if the scope of work changes.
