PNZ signs off on Eagle County subdivision‑exemption legalization for 257 East Valley Road, defers development comments

The Basalt Planning & Zoning Commission on April 21 reviewed an Eagle County referral seeking to legalize a nonconforming parcel at 257 East Valley Road, the former gas station site west of Elam Bend/Highway 82. Carlton Henry, Planner 2 for the Town of Basalt, explained that Eagle County has indicated subsequent development review will be required and that PNZ should limit its referral comments to the subdivision‑exemption (lot legalization) rather than architectural or site details.
Michael Forest of Lello Property Group, who was online for the meeting, told PNZ the team is still refining proposals and that tonight’s request focuses on the lot legalization. Staff and commissioners discussed the curb cut and whether the CDOT access permit has been vacated (staff said the curb cut vacation is proposed and documented in materials and remains technically live with CDOT until formally vacated), and they raised concerns about intersection capacity at Elam Bend and Highway 82.
After discussion, PNZ voted to authorize staff to send a letter stating the commission has no comment on the parcel legalization and will reserve substantive development review comments for any future, noticed development application before the Roaring Fork Valley planning body or Eagle County. Motion carried.
