Sunset Beach council rejects trial allowing push‑cart vending on the strand

The Town of Sunset Beach council voted May 4 to deny a proposed trial that would have allowed push‑cart vendors on the beach strand during the summer season. The motion to deny carried on a voice vote after an extended public comment period in which dozens of residents and business owners urged the council to preserve the town's low‑key, noncommercial character.

Supporters of a trial had suggested limiting permits (two carts) and running the pilot from Memorial Day through Labor Day to gauge public response. Opponents argued the ordinance was rushed, poorly worded and would be difficult to enforce; several warned that even a restricted pilot would be the start of a slippery slope toward commercialization.

The council heard a string of public comments, including local business owners who asked for more time to prepare equipment and a transparent selection process. A repeated theme from residents was concern about environmental harms to sea turtles and shorebirds and an expected increase in litter and cleanup costs for the town.

Town staff told council the draft ordinance drew on examples from other area beach towns and included permit fees, cart size and operational restrictions. Staff also said the town attorney had reviewed the language and noted the town could not lawfully limit permits only to businesses located inside Sunset Beach; that limitation would expose the town to legal challenge.

Council members questioned the short timeline before the coming summer season, enforcement practicalities and fairness to established brick‑and‑mortar businesses. After discussion, a motion to deny the ordinance was made, seconded and approved by voice vote.

The council's action rejects the immediate pilot; it does not preclude future proposals. Staff and council members noted that if the topic returns, they expect more public outreach, clearer draft language and specific enforcement plans before any permit program is considered again.
