Committee approves third 30-day permit extension and $100,000 additional escrow for downtown BOA building purchase

Bart Klein of Klein Sweeney Associates briefed the Property Management Committee on design-development work for the BOA building, noting that American Constructors is serving as construction-manager-at-risk and that staff are confirming site and envelope conditions ahead of final buyout estimates.
"Last week or two weeks ago, the contract was executed with American Constructors. They are our construction manager at risk partner," Klein said, and explained the project scope includes three floors totaling roughly 32,000 square feet, an estimated 108 parking spaces (60 onsite, remainder offsite or on-street), and built-in contingencies and alternates to manage unknowns.
Klein and staff said the county has used two extensions during due diligence and the team expects to ask the county commission to elect a third 30-day extension at the May commission meeting to complete permitting and verification work. County counsel reported the county currently has $350,000 in nonrefundable escrow applicable to the purchase price; exercising the third option would add $100,000, bringing the total escrow to $450,000 (nonrefundable but credited toward the purchase price).
A motion to exercise the third option and to forward the matter to budget and the county commission for the additional $100,000 deposit passed on roll call as recorded in the transcript: Commissioner Hall — no; Commissioner Phillips — yes; Commissioner Irving — no; Commissioner Anthony Johnson — yes; Commissioner Davidson — yes; Commissioner Paul Dodd — yes; Chairman McAdoo — yes.
Klein told commissioners he expects a commission decision in June that could allow closing in June or July and construction to begin later in the year if the body elects to proceed. Staff will return to the commission with the extension request and updated financial estimates; the committee directed staff to move the extension forward to budget and the commission as recorded.
