Sunnyvale planning commission backs 45‑day moratorium on new 'smoke shops' while regulation is studied

The Sunnyvale Planning Commission voted unanimously Tuesday to recommend that City Council adopt an urgency interim moratorium that would bar new retail establishments defined as "smoke shops" while staff evaluates local permitting and enforcement options.
City Attorney Rebecca Moon said the moratorium would initially run for 45 days and could be extended while the city studies whether to adopt a local permit program or participate in a county permitting effort. Moon told the commission that county inspections had identified flavored‑tobacco sales in several shops and that some operations had offered products that may be illegal under state law.
"Because the city of Sunnyvale doesn't have any permit, local permit requirement or any zoning restrictions on these shops, unlike many of our neighboring jurisdictions, there is a possibility this is a more attractive area for these shops to locate," Moon said, citing the need to study a regulatory framework and an enforcement mechanism that would allow the city to revoke permits for noncompliant operators.
Commissioners asked for definitions and enforcement details during the hearing. Commissioner Cerrone noted that prior county inspections led to citations and seizures but asked whether the city has the administrative tools to close noncompliant shops; Moon said a local permit regime would provide an enforcement pathway the city lacks today.
Motion and vote: Commissioner Davis moved the recommendation, Commissioner Sigura seconded, and the commission passed the motion 6‑0 with Commissioner Fagonei absent. The recommendation will appear on an upcoming City Council agenda for final action.
Next steps: staff will prepare a draft interim urgency ordinance and a report describing permit‑program options and enforcement mechanisms for Council consideration.
