Hayden City Council unanimously denied a request from Viking Construction to set a future reconsideration hearing of an earlier appeal, after staff and the city attorney told the council that the statutory criteria for reconsideration (clerical error, new evidence, procedural error, fraud, or change in circumstances) were not demonstrated.
The council’s decision preserves the existing administrative record for the underlying appeal; staff noted the applicant retains other legal options, including a regulatory‑takings analysis already submitted and the ability to petition for judicial review in district court.
Council President Dri and Council members Rotor and Ericson voted to deny the request. Staff advised that the record is robust and that denial did not preclude other legally available remedies for the applicant.
