Iron County Commission approves two rezonings, tables CRA extension and denies one charitable exemption

Brett (speaker 10), presenting for the applicant H2 Family Limited Partnership, told the commission the proposal includes on-site roads, a well and a 12,000-gallon fire-suppression tank and that CC&Rs would restrict commercial short-term rental uses.
The commission also approved ordinance 2026-11 to change 17 parcels (about 346.74 acres) owned by Linford Nelson from RA-20 to A-20. The owner’s representative, Brett (speaker 10), said the owner wants flexibility to use on-site material resources (gravel) and noted the parcels are existing 20-acre legal lots not eligible for further subdivision; neighboring residents raised concerns about intensive agricultural uses and road conditions during the public hearing.
On economic-development matters, the board approved the annual increment payments for three community development project areas (3 Peaks, Cove Mountain 1 and Cove Mountain 2) after staff (speaker 13) confirmed contract requirements were met. The commission voted to table a proposed extension of the Brian Head Community Reinvestment Area (CRA) so staff can consult with the school district about participation and revised percentage splits.
As the Board of Equalization, commissioners approved a staff recommendation to deny a charitable property tax-exemption application related to a nonprofit associated with a for-profit operation (described in the record as Iron Ice / KJ’s Ice Barn). County staff (speaker 3) said the ownership structure raised questions under state statute (UCA 59-2-1101) about private benefit; the denial will permit an appeal and review by the state tax commission.
