Larimer County commissioners approve road‑width appeal for Windcliff short‑term rental over safety concerns

Larimer County commissioners on May 11 approved an appeal to county roadway standards that will allow a short‑term rental on Youngfrau Trail in the Windcliff Estates subdivision, despite the roadway narrowing to 16 feet in places where the county standard is 20 feet.

The board voted 3–0 to approve re‑appeal file 25GNRL0579, a staff‑recommended action granted "subject to the conditions in the staff report," Commissioner Stevens moved. The property at 1458 Youngfrau Trail is owned by David Graham and Melinda Reese; Reese, the applicant, spoke in favor of the request at the hearing.

Planner Samantha Lascher told the board the appeal is limited to one roadway segment whose measured widths range from 16 to 18 feet, and that county engineering and referral comments support the narrowness exception. "Staff has found that all applicable criteria have been met," Lascher said; the appeal referenced appendix G of the Larimer County Rural Area Roadway Standards and the five appeal review criteria in the land‑use code.

County engineer Connor Sheldon said the county relies on emergency services for access analysis and that Estes Valley Fire Protection District (EVFPD) "indicated they could get to the property" and had not raised major concerns. Sheldon described mitigation measures in Windcliff—year‑round road maintenance, pavement, on‑site snow‑removal equipment and a staffed gatehouse—that staff cited as reasons this narrow segment is acceptable. "We lean on emergency services for their feedback," he said.

Applicant Melinda Reese, who said she has personal experience with wildfire evacuations, described Windcliff as a Firewise community with posted evacuation information for renters. "I take all of those concerns very seriously," Reese told the commissioners.

Chair Jody Shabby Valley, who noted an active wildfire and evacuations in her district during the hearing, pressed staff on whether fire apparatus could arrive while residents were evacuating. "Lives are lost," she said, explaining her reluctance. Commissioners Kefalas and Stevens said they would support the appeal based on EVFPD's referral and the community's infrastructure improvements, but both and the chair urged caution about allowing multiple deviations across a neighborhood.

There were 33 property owners notified within 500 feet of the subject parcel; staff said there were no public comments received on the application and five referral agencies were asked to review, with two submitting comments. Lascher also noted prior approvals for other Windcliff roadway deviations and that a previously narrow turn at Windcliff and Eagle Cliff Drive has been widened to improve access to higher elevations.

The board approved the consent agenda earlier in the meeting, which included the Leopold rezoning consent item (file 25CO‑NE3826). The re‑appeal approval will allow the applicant to proceed with a separate administrative special review process required for the short‑term‑rental use.
