Speaker 5 summarized a briefing by “Cash” that highlighted HP 60, a proposed water-rights amendment, and SB 284, which would require public water suppliers to prepare more detailed 40-year plans. The committee discussed a Bureau of Reclamation scenario that could include releases from Flaming Gorge to bolster Lake Powell and protect hydropower generation.
Several members said HP 60 is notable because it appears to allow consideration of water quality and availability when determining whether a new water right would be detrimental to the public welfare. Speaker 3 described the change as potentially game-changing: if the burden of proof shifts to developers, the town’s leverage increases. “If it truly puts the burden of proof on the developer, that’s a huge change,” Speaker 3 said.
Speakers cautioned, however, that legal interpretation will take time and may depend on court cases. The committee resolved to monitor the legislation and to prepare comments on the county’s preservation and general-plan materials where appropriate, while recognizing that many details likely will be clarified only through future administrative rulemaking and litigation.
No formal county- or town-level positions were adopted at the meeting; members emphasized further review and possible comment submission once statutory language and implementing rules are clearer.
