Dodge County Board of Adjustment denies shoreland variances for Weis Trust, approves garage setback for Steiner

The Dodge County Board of Adjustment on July 17 denied variance requests from the Rodney & Rosalyn Weis Living Trust for a deck near Fox Lake and an increase in impervious surface, and approved a separate highway setback variance for homeowner Brian Steiner.
The board unanimously denied two variance requests from the Weis Trust to the Dodge County Shoreland Protection Ordinance. The applicant sought relief from Subsection 6.2 (the Ordinary High-Water Mark setback) to allow a deck proposed at 40.1 feet from the OHWM of Fox Lake — 17.85 feet inside the required setback — and from Subsection 9.4 (impervious surface) to raise coverage from 46.75% to 49.81%, a 3.06 percentage-point increase. Lou Davis spoke in favor of the Weis petition during the hearing. Board member Mark Othmer moved to deny the impervious-surface variance; the motion was seconded by Jon Schoenike and passed 5-0. Jon Schoenike then moved to deny the OHWM setback variance; Russell Kottke seconded and the motion passed 5-0.
The board then considered a variance filed by Brian Steiner to the Dodge County highway setback rules (Subsection 4.2 and Table 1-1). Steiner requested permission for an attached garage to be sited 24.5 feet from the Second Street right-of-way, which is 2.5 feet inside the required setback. Tim Fletcher, identified at the hearing as Town of Burnett chairman, and John Peachey, Town of Burnett Land Use Administrator, spoke in favor of Steiner’s request. Russell Kottke moved to approve the variance without conditions; Rodney Justman seconded the motion and the board voted 5-0 to grant the relief.
The board handled routine business at the meeting’s start, approving the June 19 and July 10, 2025 minutes on separate 5-0 votes, and confirmed that staff (Andy O'Brion of the Dodge County Land Resources and Parks Department) had complied with open meeting and public-notice requirements. The agenda noted two petitions scheduled for the August meeting (Oak Grove and Fox Lake). The meeting adjourned after a motion by Jon Schoenike, seconded by Russell Kottke.
Appeal rights were read into the record: any person aggrieved by the board’s decision may file a verified petition in the county circuit court within 30 days of the decision’s filing, per the Board’s published procedure.
