Board of Adjustment approves Reindls’ highway-setback variance with recorded agreement condition

The Dodge County Board of Adjustment on Sept. 18 approved a variance allowing Jeffrey and Julie Reindl to construct an accessory structure that does not meet the county highway setback requirements, with a condition that a recorded agreement to protect the county be filed prior to issuance of the variance.
According to the application filed Aug. 13, 2025, the proposed accessory structure would be 88 feet from the roadway centerline and 55 feet from the right-of-way line; the board's record describes those measurements as 12 feet within the required setbacks under Subsection 5.2.3 and Table 5.1-1 of the Dodge County Land Use Code. Rodney Justman moved to approve the variance; Brad Kufalk seconded, and the motion carried 4-0.
The board conditioned approval on a recorded variance agreement: the applicant must record an agreement with the Register of Deeds in an amount equal to the value of the shed before the variance will be issued. No further amendments or conditions were recorded in the meeting minutes.
Andy O'Brion presented the staff report at the hearing and the board voted after reviewing the record and the board's standard finding criteria for variances. The minutes record no public opposition and no requests for additional study. Under the board's direction, staff will proceed to issue the variance once the required recording is submitted and recorded.
The board also noted one petition for October (Rubicon) under other business and then adjourned. Any person aggrieved by the board's decision may file a petition in the circuit court within 30 days of the filing of the decision with the Board of Adjustment.
