County says undisclosed hazardous materials at Fuller demo could add up to $400,000; four-story design favored

Kent County facilities staff told the Kent County Building Authority March 11 that hazardous materials not identified in the initial demolition analysis continue to surface at the Fuller Administration hospital demo site, a development that has prompted legal action and could increase costs.
Tim Bradshaw, facilities management director, said the County’s legal team has placed the vendor that performed the initial hazardous-materials analysis on notice and filed an errors-and-omissions complaint. Bradshaw said the development ‘‘could result in additional costs to the County depending on outcomes’’ and estimated the worst-case additional expense at "up to $400,000."
Bradshaw said staff have scheduled a meeting with Erhardt Construction to discuss how to handle any further findings and to avoid delaying the demolition timeline, which county officials called important for project schedule integrity. Bradshaw added staff are reviewing the original RFP and are committed to maintaining constructive dialogue with both vendors as the issue is resolved.
On design, Bradshaw said leadership and the project team are reviewing building concepts and that a four-story building with larger floor plates is currently favored to give departments flexibility for future moves. Design concepts are due to be presented to the Board’s Executive Committee at the end of March, followed by a full-board work session in late April; cost estimates will be brought to the Kent County Board of Commissioners in May to inform potential changes to bond request amounts.
No formal vote was taken on the Fuller Administration design at the March 11 meeting; staff indicated further design and cost decisions will proceed once presentations to the Board are complete.
