Clarkdale council approves ordinance adding child-care sites to marijuana 500-foot buffer

The Clarkdale Town Council on Jan. 13 adopted Ordinance 447 to amend Chapter 4, Section 4-230 of the town zoning code to account for preschools and child-care facilities when calculating the 500-foot buffer that restricts where marijuana dispensaries may locate.
Community Development Director Scott Ellis said the change is a housekeeping update to align the town code with what he described as March 2025’s "Senate Bill 11:05," which added preschools and child-care facilities to the state buffer requirement. He told council the change does not affect the cost of housing; that statement was read as required when adopting zoning text amendments.
Council members asked no substantive questions on the ordinance. Vice Mayor Hunetter moved to approve Ordinance 447; Council member Jones seconded the motion. The council voted unanimously to adopt the ordinance and authorized the mayor, town attorney and town clerk to execute the implementing documents.
The ordinance was presented as a narrowly scoped amendment to the zoning code. No fiscal or operational impacts on housing construction were identified during the meeting, and staff said the required housing-cost statement concluded the change does not affect housing costs.
