Wildwood Crest repeals local public-conduct code to align with state law

The Borough of Wildwood Crest voted unanimously to repeal portions of its local public-conduct code on second and final reading during the council meeting on a motion to adopt Ordinance 1462.
Mayor said the change is intended to eliminate confusion after recent New Jersey legislative changes removed criminal penalties for some conduct and eliminated municipal authority to prohibit alcohol consumption on private property. "We're just cleaning up the code to make it compatible with the state statutes," the mayor said during the public hearing.
The ordinance repeals article 1 public conduct, sections 48-12 through 48-12.4, of chapter 48 (peace and good order). The clerk opened and then closed the public hearing after receiving no callers on the conference line; the roll-call vote to adopt the ordinance was recorded as Mr. Schiff, Mr. Franco and Mr. Cabera — all voting yes.
Why it matters: the repeal clarifies local enforcement authority and removes a municipal prohibition that the speaker said the state legislature effectively eliminated, reducing the chance of inconsistent enforcement or public confusion.
Looking ahead: the borough will advertise the ordinance as required by law. The commission did not take additional immediate code changes at the meeting.
